A HUMAN RIGHTS-BASED APPROACH TOWARDS JAIL DECONGESTION AT THE BUREAU OF JAIL MANAGEMENT AND PENOLOGY IN BICOL REGION: AN EVALUATION

Abstract
This study assessed the status of implementation of human rights base approach to decongest jails under the control of the Bureau of Jail Management and Penology in Bicol Region. It was conducted in Daet, Tabaco City, Tigaon, Naga City, San Andres, Virac, Iriga, Sipocot and Labo District Jails and in Legaspi City Jail on a basis that these jails are heavily congested. It sought answers to the following concerns: 1. What is the status of implementation of human rights-based approach at BJMP-manned jails in Bicol Region? 2. What are the gaps in the implementation of human rights-based approach at BJMP-manned jails in Bicol Region? and 3. What action plan can be proposed to address the perceived gaps and challenges?

The Regional Director, Paralegal Section Chief, Jail Wardens, all members of MSEC and TAS comprised the personnel respondents. On the other hand, six inmate-respondents were selected from each jail.

Findings of the study showed that human rights-based approach is being implemented at BJMP-manned jails in Bicol Region as evidenced by the various documents indicating the points earned by inmates and the list of inmates who benefitted from the program. However, some jails are selective in offering the program due to the limited space, lack of intervention program, limited number of personnel and for security reason.

In terms of gaps and concerns that affect its implementation, it was learned that most implementers have multiple tasks; they lose interest in making reports and attending the MSEC meetings because they lack proper training on how to implement RA 10592; jail activities and venue are limited; limited number of inmates are allowed to participate for security reason and there is a limited logistical/operational fund.

Proposed action plan to address these were the construction of additional jail facilities; conduct of training/seminar to all implementers; inclusion of RA 10592 in the Program of Instructions of the National Jail Training Institute; hiring of additional personnel; implementation of additional activities and provision of cash incentives/logistical support to implementers; continued coordination, partnership and linkages to various stakeholders for additional development activities and speedy release of inmates; designation of appropriate number of implementers and prohibiting Wardens from giving multiple tasking to these personnel.
