Abstract
This study is an analysis of dismissed drug cases in the prosecution level from 2016 to 2021 filed by QPCD based on the operationalization of the Protection Analytical framework (GPC, 2021). The four areas of PAF served as the basis for analyzing inadmissibility of evidence, inconsistency of testimonies, and insufficiency of evidence. Data were extracted from CIRAS, from interviews with PNP personnel, prosecutors, and lawyers who handled drug cases. The analysis revealed lapses in the part of the drug operatives failed to convince the prosecutor as to the existence of probable cause, while the inadequate capabilities and internal polices of the PNP affected the anti-drug operations on legal context and the role of police operatives as social agency and the mechanisms of control in the PNP. On the other hand, the existence of dismissed cases is an indicator of the challenges according to its priority effects in the image of the organization. Apparently, the existing efforts are not enough to address this issues. Unfortunately, some of the internal policies of the PNP contributed to this problem. More efforts to enhance the capabilities of the drug operatives must be implemented and a revision of PNP’s internal policies must be enacted to enhance the efficiency and affectivity of the drug operatives in ensuring a drug-free society
