Abstract
Sexual abuse against women in police custody is one of the devastating gross violations of domestic and international human rights laws. It is a controversial issue that is hidden in the shadows of custodial facilities in the country a crime that is neglected and under-reported. This current study aims to address sexual abuse against women under police custody and formulate a plan of action to effectively prevent sexual abuse against women in police custody from occurring data is obtained through a qualitative analysis using Focus Group Discussion, Key Informant Interviews, survey questionnaires, content, and document analysis of available records including related studies and articles from professional journals, newsprint, and digital materials. The significant factors that contribute to sexual abuse against women in police custody include age for younger women pleasing personalities, lack of a strict policy for handling women in police custody, and the ability or the abuse of power of the PNP personnel to take women in and out if the custodial facilities. Further, the issues and challenges encountered by victims of sexual abuse in police custody include: non-complaint with international and domestic human rights standards in handling women in police custody not being provided with basic items for human dignity, lack of mental and health care support, unsafe and unsecured, overcrowded custodial facilities, fear and retaliation, blue code of silence, and lack of female officers to supervise women in police custody. The findings indicate that sexual abuse against women in police custody is common knowledge in the police force and that there is sexual abuse against women perpetrated by police personnel. This is an attack on the integrity of the PNP. Therefore, this study recommends comprehensive policy reforms and programs in handling women under police custody to prevent sexual abuse against women and ensure safety and security whenever they are taken in and out of the custodial facilities.
