LEGAL OFFENSIVE AGAINST COMMUNIST-TERRORIST GROUPS (CTGs) IN SUPPORT TO END LOCAL COMMUNIST ARMED CONFLICT IN THE PROVINCE OF LAGUNA

Abstract
The study assessed police procedure related to legal offensive in support of ELCAC with the main variables of investigation and documentation, prosecution, and agency collaboration. The study was conducted on Laguna among the police officers, prosecutor, and local government leaders. The research was conducted in 2020. Based on the findings of the study, the following conclusions are drawn:
1. The Laguna Police Provincial Office has highly undertaking its legal offensive strategies against communist terrorist groups mainly due to its evidence preservation and following investigation procedures, maintaining good relationship with the criminal justice system, and engaging the peace and order council (POC) for necessary support
2. The main problems affecting the legal offensive of the Laguna Police Provincial Office were the many cases overloading the investigators, inadequate secure facilities to detain arrested insurgents, and inadequate support of some peace and order council on the legal offensive strategy.
3. An action plan is proposed based on the results of the study entitled Totally eradicating Laguna of Communist Terrorist Groups through Legal Offensive.

Based on the conclusions of the study, the following are recommended:
1. The Laguna PPO must designate a dedicated investigator for legal offensive, train police officers in proper handling of cases of CTGs and maintain case monitoring and follow up with the prosecutors. It must sustain the best practices it has been implementing in its legal offensive strategies such as ensuring evidence preservation, proper handling of evidence and maintaining good relationship with the criminal justice system, and engaging the public order councils for necessary support.
2. The Laguna Police Provincial Office shall make an assessment of the facilities and logistical support needed for its legal offensive strategy such as safe houses, secured building for evidences, and forensic tools. Constant collaboration with the prosecutors must be systematized by the Laguna PPO. The inputs of the prosecutor must be considered in order to ensure high rate of conviction of CTGs. Additional investigators may be assigned whenever cases involving CTGs increase. Collaboration with the criminal justice system must be nurtured by Laguna Police Provincial Office. The groups in the communities and the Barangay government may also be involved as they have the most immediate experiences on the offenses of the CTGs.
3. The action plan proposed in this study must be presented to the Laguna Provincial Peace and Order Council for proper approval and funding.
