THE DISPOSITION OF ADMINISTRATIVE CASES IN THE NATIONAL CAPITAL REGION INTERNAL AFFAIRS SERVICE: FRAMEWORK FOR A COMPETENCY BUILDING PROGRAM

Abstract
The research study us entitled “The Disposition of Administrative Cases in the
National Capital Region Internal Affairs Service (NCRIAS)”. This study aimed to assess
the disposition of administrative cases in the National Capital Region Internal Affairs
Service (NCRIAS) relative to aforecited variables and the measure to address the
problems encountered by problems are encountered by the respondents that disposition
of administrative cases in the National Capital Region Internal Affairs Service
(NCRIAS). Further, it determined whether there is a significant difference on the
assessment of the three (3) groups of respondents on the administrative cases in the
National Capital Region Internal Affairs Service (NCRIAS), problems encountered and
the corresponding measures in relation to the aforementioned variables. This study
made used three hundred two (302) composing of three groups of respondents namely:
Police Personnel with solved cases with one hundred forty three respondents (143),
Police Personnel with Pending Cases with one hundred forty three respondents (143)
and Implementers with sixteen respondents (16). The survey instruments and the
interview guide were used in gathering the needed data. Also, it includes percentage,
average weighted, f-test as statistical tools. The study was conducted at the National
Capital Region.
The findings of the study revealed that the Disposition of Administrative Cases in
the National Capital Region Internal Affairs Service Framework for a Competency
Building Program in terms of pre-charged investigation, summary of hearings, and
resolution of the case are effective. They are effective in terms of preparation of
necessary supporting documents but they need to enhance preparation of transmittal
report and recommendations for summary hearings; preparation to complete summary
hearing report although they have limited number of trained summary hearing officers;
and execution of final decisions. However, they experience delay in the submission of
case resolution within the required time frame.
There us serious problem encountered by the NCRIAS that affect the
effectiveness in the disposition of the administrative cases in the aforementioned
variables such as: insufficiency of gathered evidence that may affect the disposition of
the case; delays in the disposition of cases due to postponement of trials; and bias
decision is already part of the resolution of the case;
The proposed measures to address the problems encountered that affect the
effectiveness in the disposition of the administrative cases are all recommended
particularly the following: need to conduct trainings and seminars on proper
investigation to enhance processing of cases; needs to hire lawyers who will be in-
charged for the preparation of the decisions; and have directives on prohibiting
influence and peddling to expedite disposition of the case.
Based on the findings of the study, the following conclusions are drawn: the
NCRIAS is effective in the disposition of the administrative cases. However, there is a
need to enhance the manpower capability through hiring and trainings of qualified
personnel in order to enhance case investigation and preparation of transmittal report
and recommendation; the NCRIAS encountered serious problems in gathering of
evidence, delays and bias decision in the disposition of administrative cases; the PNP
personnel with solved and pending cases, and the implementers recommend the
trainings on investigation , assign additional PNP lawyers and legal researchers in-
charged for the processing and preparation of necessary documents; there is a
significant difference in the assessment of the three groups of respondents on the
disposition of administrative cases in NCRIAS and the problems encountered that affect
the disposition of cases. However, there is no significant difference in the assessment of
the proposed solutions relative to the given variables; the formulation of the action plan
is based on the result of the findings of the assessment, problems encountered, and the
proposed solutions which include additional manpower, trainings and screening and
evaluation committee.
Based on the findings and conclusions the following are recommended: Appoint
qualified personnel who will undergo extensive training on investigation of administrative
cases and in-charged for preparation of reports and recommendations; Assign PNP
lawyers in-charged for the preparation of the decision and supervision in the processing
of the required documents to expedite case resolutions; Encourage PNP lawyers to join
the NCRIAS and create a review committee in-charged for the screening and evaluation
of all documents necessary for the disposition of the administrative cases; The
proposed solutions should be adopted by the NCRIAS since the three groups of
respondents agree that there is a need for a qualified personnel, trainings, and
screening committee; The NCRIAS should adopt the proposed action plan that will
address the problems on delay of processing of documents and bias in the decision of
the case; and Further study should be conducted concerning the factors that affect the
NCRIAS in the processing and disposition of the case in order to identify the aspects
that contribute to the effectiveness of the unit.
