Abstract
The study aimed to assess the existing Law in relation to false bomb threat incidents in the airport as well as the challenges by PNP Aviation Security Group investigators in implementing the existing law. The participants are the Philippine National Police Aviation Security Group (PNP AVSEGROUP) and Office for Transportation Security personnel assigned in the various terminals of NAIA. Both qualitative and quantitative methods of research were used. Likewise, proportionate random sampling was used after computing the sample size. Result revealed that there were challenges encountered by PNP AVSEGROUP personnel in relation to the implementation of PD 1727 since their task is mostly until the filing of cases. Likewise, the problem lies on the law itself as it was found out that it is no longer responsive. Remedies are being suggested by substituting the PD 1727 by Republic Act No. 9497 (Alarms and Scandals) of the Revised Penal Code as amended by RA 10951, or escalation of these cases to violation of Republic Act No.10591. Recommendations include: (a) prioritization of the approval of House Bill No. 9059 which aims to increase the penalty for willful dissemination of false information; (b) revisit current internal procedures and basis for filing of substitute cases with respect to PD 1727; (c) enhance the competency of the police personnel by educating them on possible alternatives to ensure prosecution of offenders; and (d) case monitoring to have data on conviction rate while awaiting the approval of House Bill 9059.
