Abstract
This research addresses the issue of police non-appearance in court
by identifying social and technical factors influencing officers’ attendance. A quantitative approach, specifically the descriptive method of research, was used to achieve its objectives. It aimed to assess the status of PNP personnel who failed to appear on court duty, focusing on rank, assignment, and training background. Additionally, the study explored the perceptions of respondents regarding the determinants of non-appearance and identify potential areas for improvement within the PNP system.
The study’s findings underscore the need for practical measures to enhance court duty attendance and strengthen the justice system. The findings reveal that social determinants have a significant effect on officers’ inability to attend court, with a majority citing unavoidable or emergency police duties that required their immediate attention at the time of the hearing. Furthermore, technical determinants also play a role, as many officers reported facing challenges with the simultaneous scheduling of two hearings, prioritizing attendance at the one held by the higher court. Understanding these complex factors is crucial to developing targeted solutions to improve officers’ court attendance and enhance the overall effectiveness of the justice system.
An action plan is presented to address the issue of unreliable court duty attendance by PNP personnel and enhance the PNP’s ability to secure police witnesses’ presence during court hearings. Proposed solutions include improving training programs, fostering accountability among personnel, establishing clear policies, and optimizing communication with judicial bodies. Legislative or policy changes to promote witness accountability are also recommended. Implementation of these measures is expected to lead to increased reliability and efficiency in court duty attendance, benefiting the overall justice system in the Philippines.
