Abstract
THE CASE

Talisay is a Class C municipality in the Province of Batangas with 21 Barangays and a population of 47,678. It has a land area of 2,622 hectares and has an economy that mainly driven by agriculture, fishing, and resorts. The Talisay Municipal Police Station (TMPS) has a total strength of 60 personnel composed of 2 Police Commissioned Officers, 54 Police Non-Commissioned Officers, and 4 Non-Uniformed Personnel. This brings the police to population ration to 1:883.

The crime volume in Talisay has increased from 134 in 2021 to 144 in 2022. This has necessitated the conduct of intensive law enforcement operations and activities of TMPS that has consequently resulted to high arrest rates. This, together with other external and internal factors, contribute to the overcrowding often experienced in the custodial facilities of TMPS.

Persons Under PNP Custody (PUP), formerly known as “detainees,” are persons who are being hold by the PNP in its custodial facilities who were arrested for an offense or previous violation of law (PNP, 2021). In 2021, there has been an instance where 25 PUPC have been accommodated simultaneously in TMPS custodial facilities which greatly exceeds its capacity of 10 PUPC.

This raise concerns in the protection of the rights of PUPC. It also leads to a multitude of other issues that hinders TMPS from effectively performing their tasks and functions. Effective management can ensure that the rights of individuals in custody are respected while poor management can lead to human rights violations, damage the reputation of the PNP, and result in legal and financial liabilities.

TMPS aims to formulate effective that would solve this problem. It is necessary to determine internal bottlenecks and gaps that contribute to the persistent overcrowding problem in custodial facilities. This includes identifying all factors affecting the timeliness and efficiency of the facilitation of PUPC. The specific steps and procedures involved in the facilitation of PUPC must therefore be analyzed. There must be a comprehensive study and analysis of current processes and procedures to identify possible points of improvement.
