ANALYISIS ON THE DISMISSED CASES OF TUGUEGARAO CITY POLICE STATION FOR VIOLATION OF COMPREHENSIVE DANGERIOUS DRUGS ACT OF 2002

Abstract
Introduction
Republic Act 9165 otherwise known as Comprehensive Dangerous Drugs Act of 2002 mandates the government to pursue an intensive and unrelenting campaign against the trafficking and use of dangerous drugs and other similar substances in the country. It was created due the policy of the state to safeguard the integrity of its territory and the well-being of its citizens particularly the youth from the harmful effects of dangerous drugs on their physical and mental well-being, and to defend them against acts or omission detrimental to their development and preservation. On June 30, 2016 during the inauguration of His Excellency Rodrigo Roa Duterte as the President of the country, he declared war on drugs, to completely eradicate the drug menace in the entire country and targeted a drug-free Philippines. He then directed the PNP to lead the fight on illegal drugs and in relation to the directive of the President, the PNP crafted Command Memorandum Circular No. 16-2016 that sets forth the general guidelines, procedures and tasks of police units in the conduct of the Anti- Illegal Drugs Campaign. This is to address illegal drug problems in the barangays and at the same time pursue the neutralization of illegal drug personalities as well as the backbone of illegal drugs network operating in the country. Then PNP and other concerned agencies became more aggressive and serious on the war on drugs. Several anti-illegal drugs operations conducted and cases for violation of Republic Act 9165 were field against violators.
Deduced from the forgoing, the role of law enforcement sector in the maintenance of peace and order in the community is immensely significant most especially on the mandate of the police to curb the menace of drugs in the country. The vital role of the Philippines National Police serves as the security blanket of the people and they deliver services that protect the rights of the women, children and the people from all sector of the community. They also make sure that the community is safe and secured from the elements that being fear and disturbance to the peaceful living of the people.
Tuguegarao City in the Province of Cagayan is not spared from the modern plague brought by illegal drugs, in fact with the continuous development of the city as the Regional Center of the Cagayan Valley region, hailed as the center for education, commerce and industry, this may however inviting habitat for illegal drug trade and all forms of criminality in the city.
In the locate of the study, Tuguegarao City through the local Government Unit, City Peace and Order Council, Barangay Officials and other stakeholders succeeded in the campaign on its war against illegal Drugs and Anti Criminality. In response to the directive of the President to address the illegal drugs problem in the country, Tuguegarao City Police Station has performed its mandated task that contributed to the Attainment of lower crime incidents for CY 2017 to present after the whole Province of Cagayan was declared into state of criminality in 2010 due to tremendous increase of crimes.
TuguegaraoCity, unlike other cities, is often hidden in the lens of the media and cameras. Unknown to some, it has a rich history, diverse natural resources, and colorful culture and heritage
Tuguegarao City is a major urban Center in Northeastern Luzon and considered to be the Primary Growth Center by the Department of tourism (DOT) (www.dotregion2.com.ph).It has a land area of 144.8 km2 and has a total population of 168, 898. The City is politically subdivided into 49 barangays 31 of these barangays have agriculture territories although some of the urbanized ones have mixed commercial, residential and agricultural sites.
Tuguegarao City Police Station has a total strength of 10 Police Commissioned Officer; 271 Police Noncommissioned Officer wherein 76 of it are WPS; and complemented by 6NUPS.
This case study has been conducted to determine the number of dismissed case and reasons on the dismissal of cases relative to illegal drugs for calendar year 2017 to present, the issues and concern in the locale of the study and the interventions set by the Tuguegarao City Police Station to cover the gaps relatives to the identified problem.
